The Council of State rejects E-PANGO's appeal against the Energy Regulatory Commission

E-PANGO, energy supplier for businesses and communities, saw its appeal against the Energy Regulatory Commission (CRE) rejected by the Council of State. The decision, rendered on July 19, 2024, concerns an ARENH price supplement for the year 2022.

E-PANGO contested the decision of June 29, 2023 of the CRE concerning the calculation of this price supplement, as well as the corrective deliberation of July 20, 2023. The Council of State ruled that the CRE had not violated either law or regulation in this calculation.

Despite this rejection, E-PANGO is considering, with its advisors, the possibility of filing an action for compensation against the CRE, as suggested by the Council of State in its reasoning. This action would aim to cover the additional price and the damage suffered.
